Terms of Use Agreement for My SHIMADZU for Analytical and Measuring Instruments (“My SHIMADZU for Analytical”)

Article 1 Purpose
The purpose of the “My SHIMADZU for Analytical and Measuring Instruments” (“My SHIMADZU for Analytical”) membership (in English for Global), hereinafter “Membership,” is to offer better support to individual customers by providing information from Shimadzu Corporation (hereinafter “Shimadzu”) to customers.
Article 2 Operation
- Services of the Membership (hereafter “Membership Services”) can be freely selected by customers based on their own preferences.
- Membership Services can be canceled at any time, either in whole or in part.
- Registered member information (name, country, language, work address, telephone number, employer, job type, affiliated organization, industry, and fields of interest) can be changed at any time via the website.
Article 3 Members and Administration Office
- Members
Eligibility for Membership is limited to current or prospective users of products offered by Shimadzu or a Shimadzu Group company. Members are not registered based on their department or organization name. If Shimadzu decides that an applicant is not appropriate as a member, Shimadzu can decline registration.
Members can cancel their Membership at any time by submitting a cancelation request to Shimadzu in accordance with Shimadzu’s prescribed method. - Administration Office
The office that administers the Membership is indicated below.
The administration office shall notify members of changes in contact or other information, either separately for each change or by posting the changes on the website.

Article 4 Disclaimers
- Shimadzu offers no guarantee regarding the safety, accuracy, certainty, suitability, availability, or other aspect of the service or anything else provided under this agreement.
- Copyrights for copyrighted items provided during Membership activities are owned by Shimadzu or the copyright owner of the copyrighted item. Shimadzu shall be in no way liable for damages or losses incurred by members due to the unauthorized use of copyrighted items. Moreover, members shall be responsible for any damages or losses incurred by Shimadzu or the copyright owner of copyrighted items due to such unauthorized use.
- Shimadzu shall not be liable for member losses, even if they occur for the following reasons.
(1) Unauthorized access, infection with a computer virus, or other fraudulent actions by a third party, despite corresponding safety measures established by Shimadzu
(2) Interruption or disabling of the service, data loss, or other losses due to impairment of a communication line, system, server, or other asset for which Shimadzu is not responsible
(3) A clerical, factual, or other error in a text or other communication provided by a Shimadzu Group company - Shimadzu shall not accept any liability for any disputes that occur between a member and a third party (including but not limited to other members and Shimadzu Group companies).
Article 5 Handling Information, Etc.
- Handling Member Information
Shimadzu shall handle member registration information, site viewing information indicated in information obtained through Membership Services, and information analyzed based on such obtained information (hereinafter “Member Personal Information”) appropriately, in accordance with this Terms of Use Agreement, Shimadzu’s Privacy Policy, and applicable personal information protection laws and regulations in respective countries. - Purpose of Use
Shimadzu shall obtain member approval and execute other processes required for using member personal information, in compliance with personal information protection laws and other applicable laws and regulations in respective countries, and shall limit use to the purposes specified in Shimadzu’s Privacy Policy and the scope of uses specified below.
(1) For the operation or provision of Membership Services, etc.
(2) For responding to inquiries about products and services offered by Shimadzu or a Shimadzu Group company (including Membership Services)
(3) To provide notification about products, services, or various events and sales campaigns by Shimadzu or a Shimadzu Group company (including Membership Services)
(4) To prepare or provide statistical information related to how Membership Services or other products or services are used, or for sales activities
(5) To prevent fraudulent use of Membership Services, etc.
(6) To improve the content or quality of Membership Services, etc.
(7) To categorize and analyze the interests of Members based on their viewing and purchasing histories in order to use the results for purposes specified in the Shimadzu Privacy Policy and respective clauses of this paragraph - Supplying to Third parties
Shimadzu will not disclose member information to third parties without permission, except in the following cases.
(1) The member consented to the disclosure.
(2) All or a portion of processes involved in handling member information is outsourced to an outside vendor that has signed a confidentiality agreement with Shimadzu in advance, to the extent necessary for achieving the purpose of using the information.
(3) It was requested by a court of law or government office or is required based on a law, regulation, or other requirement.
(4) Used for the purpose of protecting a Shimadzu right or asset. - Joint Use
Shimadzu can use the framework for joint use, which is based on the Japanese Act on the Protection of Personal Information, to share registered or personal information of members between Shimadzu subsidiaries (including subsidiaries located outside Japan) and Shimadzu distributors assigned to that member, for the purposes specified in the Shimadzu Privacy Policy and this Terms of Use Agreement. In such cases, Shimadzu shall be responsible for managing that information, with Shimadzu’s addresses, representative names, and other such information as indicated in the Shimadzu Privacy Policy. - Disclosure of Member Registered Information and Member ID Information
Members can confirm registered information and member ID information via the Membership website.
Alternatively, members can request disclosure of their registered information and member ID. For such requests, Shimadzu may need to confirm the identity of the member. - Changes to Member Registered Information
(1) If registered information changes, members can change the information via the website at any time.
(2) Shimadzu accepts no liability for disadvantages incurred due to false information registered by the member. - Termination of Services
If Shimadzu judges that any of the following clauses apply to a member, Shimadzu can temporarily suspend that member’s use of Membership Services, or even delete the registration of the member, without any advance notification to the member.
(1) The member does not actually exist.
(2) The member registered using an alias, another person’s name, or a stolen identity.
(3) The registered information includes falsified information, inaccuracies, errors, omissions, etc.
(4) The registered information was deleted due to a request by the member.
(5) The member has not logged in to the Membership for at least 6 months.
(6) The member is affiliated or associated with an anti-social organization.
(7) The member did not agree to the content of this or other agreements.
(8) The member violated a requirement in this or other agreement.
(9) Shimadzu decided that Membership would be inappropriate for any other reason. - Contact Point for Inquiries about Personal Information
Members can request limitations or other rights for accessing, correcting, deleting, or processing their personal information held by Shimadzu, in accordance with methods specified in the Shimadzu Privacy Policy or by using the contact form indicated below.

Article 6 Authentication Information
- Member Passwords
Password settings can be changed via the [Forgot Password] page. A reply is automatically sent to the registered email address. - Cookies and Log Files
The Membership website uses cookies for authentication. Cookies and log files are sometimes used to gather information, such as website viewing history. Browser settings for the browser used by the member can be used to configure settings such as whether to send/receive cookies, send notifications when issued, or disallow receiving cookies.
Article 7 Changes to Registered Information for Other Information Services
If a member changes Membership authentication information, they can also change authentication information for other information services at the same time by contacting Shimadzu to request the changes. Member information for other memberships might not be changed unless requested.
Article 8 Revisions to this Terms of Use Agreement
This Terms of Use Agreement is subject to revisions by the Membership Administration Office whenever deemed appropriate.
The Membership Administration Office shall notify members of any such changes, either directly each time a change is made or by posting changes on the website.
